Terms of purchase
The following terms and conditions govern the sale of tickets for the concerts of the “PONIENTE LIVE” series, held at Benidorm SkyFest (Benidorm, Spain), promoted and organised by PONIENTE LIVE SL, Tax ID (NIF) B05682497, with its registered address at Calle Goya 55, 5.º izquierda, 28001 Madrid (Spain) and email info@ponientelive.com (hereinafter, “the Organiser”).
These general terms are without prejudice to any specific terms applicable to particular services or products on the website. Since these general terms are displayed in a visible place on the website, guaranteeing the User the effective possibility of knowing of their existence and content, accepting them means the User accepts them in full.
Consequently, the User, under their own responsibility, must read all the terms carefully.
Specific terms will apply to certain products or services offered to users through the website, whose access or use is subject to them, and which, depending on the case, replace, supplement or modify these general terms.
If the User does not agree with the content of these general terms, they must refrain from accessing the website and from operating through it.
The Organiser reserves the right to amend these General Terms, after publishing them through this same medium, and it is the User’s responsibility to read them each time they access or use the website.
Purchasing a ticket constitutes acceptance of the following terms:
Ticket
The legal nature of the ticket is that of a negotiable instrument (título valor), in accordance with current legislation. The ticket types available for each concert of the Poniente Live series are shown on the concert page and on the ticketing platform.
General ticket
Gives the right to access the concert area on the day and for the concert for which it was purchased.
Individual VIP ticket
Gives the right to access the concert area on the day and for the concert for which it was purchased.
However, the Organiser reserves the right to release new ticket types not covered in this section (for example, General Floor, Front Stage or Boxes, depending on the concert). In any case, such tickets will be subject to the general terms of ticket sale and access to PONIENTE LIVE set out in this document.
VIP tickets
VIP tickets give the right to the area designated for them at the venue on the day of the concert. You will be entitled to fast-lane entry and a privileged view of the stage.
Suspension, cancellation or annulment of the concert
Before buying tickets for PONIENTE LIVE, it is important that you are aware of the return and refund conditions.
Once the ticket has been purchased, in accordance with current consumer and retail trade legislation, the user may not exercise the right of withdrawal or termination, since the supply of services related to leisure activities is exempt from that right.
The user will be entitled to a total or partial refund of the ticket price, not including the booking fees added to the ticket price during the purchase process, if the concert is suspended or substantially modified, except where the suspension or modification occurs once the concert has begun and is due to force majeure.
Where any case of total or partial refund of the ticket price arises, the user may request the refund within a period of no more than fourteen (14) days from the date of the public announcement of the cancellation or from the time indicated by the Organiser, using the technical procedures set by the Organiser.
The Organiser, as the entity responsible for holding the series, may alter or modify the concert programme only where necessary for its proper running, and in particular where there may be changes to performance times or artists, with prior notice to attendees; and, in any case, for duly justified reasons beyond the Organiser’s control, such as, by way of example and without limitation: the unilateral cancellation of an artist’s performance by the artist, the unilateral change of the day of the performance of one or more artists by them, or the manifest impossibility of an artist performing on the scheduled day due to circumstances beyond the Organiser’s control; all of this always in accordance with current legislation and with respect for consumer protection rules and, where applicable, in accordance with these general terms, which shall always be interpreted in accordance with the law.
Should any of the above cases or changes occur, the Organiser will make its best efforts and use all means at its disposal to adjust the times and carry out the announced concert programme.
The ticket price will not be refunded if the concert is cancelled due to force majeure. Force majeure means what is established by the Spanish Civil Code and the case law of the Spanish courts and, in particular and without limitation: natural disasters, earthquakes, floods, labour disputes, strikes, war (declared or not), rebellion, shortage of or unforeseeable delay in the supply of raw materials or necessary goods, fires, explosions, emergencies, accidents or breakdown of essential machinery, equipment or tools, action or omission of public services or the administration, sabotage, embargo, disturbances of any kind seriously affecting public order, epidemics or pandemics, any intervention or declaration by public authorities (national, regional and local), health institutions or other bodies, whether prohibiting or recommending against holding the concert, as well as any other event or impediment that does not allow or advises against holding the concert to which these general terms refer, and any unforeseeable, irresistible event beyond the organiser’s will and control that prevents the total or partial performance of the concert and cannot be overcome with ordinary diligence.
In the event of ticket refunds, please note that only the ticket price will be refunded. Travel, accommodation or any other expense related to the show that you have arranged yourself is at your own risk, and these amounts cannot be refunded under any circumstances by the ticket seller or the promoter of the show. In the event of postponement or cancellation of the concert, and without prejudice to the rights recognised in these general terms, the organiser may offer you a compensation proposal that restores the balance of interests under the contract and constitutes due and reasonable compensation.
In the event of postponement, the promoter will not be obliged to refund the amount paid. Tickets purchased will be valid for the new date.
If the cancellation is total, the promoter will refund the ticket price under the conditions to be published through this same medium, except for the distribution cost, as this is a service provided by the sales channels at the time of the ticket purchase.
Under no circumstances will the ticket price be refunded if the cancellation occurs after the concert has begun.
